This Privacy Policy (“Policy”) describes how Moevd Groups Sdn. Bhd. and its respective subsidiaries and associate companies use your Personal Data.

“Company” means Moevd Groups Sdn. Bhd. (Company No. 519029-P)

Acquiring of Personal Data

“Personal Data” means information about you, from which you are identifiable, including but not limited to your name, identification card number, passport number, birth certificate number, nationality, marital status, address, telephone number, fax number, bank details, credit card details, race, gender, date of birth, resident status, education background, financial background, personal interests, email address, your occupation, your designation in the Company, and the industry in which you work in, any information about you that you have provided to the Company in registration forms, application forms or any other similar forms and/or any information about you that has been or may be collected, used, stored, and processed by Company from time to time and includes sensitive personal data such as data relating to health, religion or other similar beliefs.

The provision of your Personal Data is voluntary. However, if you do not provide the Company your Personal Data, the Company will not be able to process your Personal Data for the Purposes and Additional Purposes outlined below.

In addition to the Personal Data you provide to the Company’s Group directly, Company’s Group may collect your Personal Data from a variety of sources such as:

• From publicly available sources such as directories,
• Fill up application or registration forms or other similar forms; When you enter campaigns and contests organized by Company’s Group, From credit reporting agencies;
• From Company’s social media pages, if you follow, like or are a fan of such pages;
  When you interact and communicate with Company’s Group at any events or activities;
• From various entities or divisions under Company’s Group; or
• By using Company’s Group websites, which includes all websites operated by Company’s Group and under the names of its respective brands (“Websites”). Your personal data may also be collected from cookies used on the Websites.

If you are an agent, vendor, supplier or service provider, provision of your Personal Data is mandatory and failure to provide your Personal Data, may be a breach of laws, contracts, or regulatory requirements, and may cause the Company to be unable to engage you to provide or products or services or issue payments to you for products or services provided.

Personal Data may be collected through the normal operation of our Apps.

Some examples are:

your location (to detect pick-up locations and abnormal route variations);

Personal Data about driver partners

If you are a driver partner, we may collect:

• telematics data (such as your speed, acceleration, and braking data);
• device data (such as accelerometer data, GPS location, your IMEI number and the names of apps you have installed on your device);
• your vehicle registration data;
• using device, location, profile, usage and other Personal Data to prevent, detect and combat fraud or unsafe activities;
• sharing drivers and passengers’ location and details when the emergency (SOS) button or the “Share Ride” feature is activated;

The Purposes of Use and Processing

Company’s Group may use and process your Personal Data for business, promotion and activities of Company’s Group which shall include, without limitation the following (“Purpose”):

When you are a customer or user of the services provided by Company’s Group:

• to provide you with any service you have requested,
• to perform the Company’s Group’s obligations in respect of any contract entered into with you,
• to process your subscriptions and to deliver the services to you,
  where you have requested to download and use the Moevd (User) or Moevd (Driver) App (“App”), to process your request, to deliver the App to you and to provide you a license for the use of the App,
• to process your participation in any events, activities, research studies, contests, campaigns, promotions, surveys or any productions,
• to process, manage or verify your application for subscription with the Company’s Group and to provide you the benefits offered,
• to understand and analize our sales as well as your needs and improvements,
  to validate your orders and process payments relating to any products or services you have requested,
  When you are a supplier, vendor, agent, partner, contractor or service provider:

for the purposes of engaging you to provide services or products, to process payments relating to any products or services you have provided, to facilitate or enable any checks as may be required by Company’s Group policies in order to award you.

General:

• to communicate with you for any of the purposes listed in this Notice,
• to respond to questions, queries, feedbacks and comments from you,
• for purposes of detection, prevention and prosecution of crime,
• for internal administrative purposes, such as data analysis, database records,
• for Company’s Group to comply with its obligations under law,

and that you agree and provide consent to Company’s Group using and processing your Personal Data for the Purposes and in the manner as identified in this Notice.

Transfer of Personal Data

Your Personal Data may be transferred to, processed, stored, and used in a jurisdiction other than your home country or otherwise in the country, state and city in which you are present while using any services provided by Company’s Group (“Alternate Country”), to companies under Company’s Group which are located outside of your home country or Alternate Country and/or where Company’s Group’s servers are located outside of your home country or Alternate Country. You understand and consent to the transfer of your Personal Data out of your home country or Alternate Country as described herein.

Unsubscribe and Revocation of Consent

If you wish to unsubscribe the processing of your Personal Data for Additional Purposes by Company’s Group, please click on the link “Unsubscribe” which is embedded in the relevant email in order not to receive any email in the future.

If you wish to revoke the consent that Company’s Group has obtained from you for the Purposes stipulated herein, please notify Company’s Group using the contact details stated below.

Promotion and Branding purposes

Company’s Group may also use and process your data for other purposes such as (“Branding Purposes”):

• To notify and invite you to events or activities organized by Company’s Group, its sponsors, partners, or advertisers;
• To process your registration to participate in or attend an event or activity and to communicate with you regarding your attendance at the event or activity;
• To send you alerts, newsletters, updates, mailers, promotional materials, special privileges, festive greetings from the Company’s Group, its sponsors, partners or advertisers;
• To share your Personal Data amongst its subsidiaries, associate companies and jointly controlled entities as well as with its agent, vendor, supplier, partner, contractor or service provider who may communicate with you to market their products, services, events or promotions.

by way of post, telephone call, short message service (SMS), by hand and/or by email.

Correction, Limiting and Inquiries of Personal Data

Subject to any exceptions under applicable laws of your home nation or Alternate Country, you may request for access to and/or request correction of your Personal Data, request to limit the processing of your Personal Data for the Additional Purposes and/or make any inquiries regarding your Personal Data by contacting:

Subject to any laws of your home nation or Alternate Country, Company’s Group reserves the right to impose a fee for access of your Personal Data in the amounts as permitted therein.

In respect of your right to access and/or correct your Personal Data, Company’s Group has the right to refuse your requests to access and/or make any correction to your Personal Data for the reasons permitted under law, such as where the expense of providing access to you is disproportionate to the risks to your or another person’s privacy.

Disclosure to Third Parties and Third-Party Websites

Your personal data may be transferred, accessed or disclosed to third parties for the Purposes and Branding Purposes. Further, Company’s Group may engage other companies, service providers or individuals to perform functions on its behalf, and consequently may provide access or disclose to your Personal Data to such service providers or third parties. The third parties include, without limitation:

• Company’s Group partners, which include parties with whom Company’s Group collaborates with for certain events, campaigns, and activities,
• Service providers, including, information technology (IT) service providers for infrastructure and software development work;
• Event management, advertising companies and event sponsors; Marketing survey and research companies;
• Professional advisors and external auditors, including legal advisors, financial advisors and consultants;
• Other entities within Company’s Group; and Governmental authorities to comply with statutory, regulatory and governmental requirements.

The Websites may contain links to third parties’ websites. Please note that Company’s Group is not responsible for the collection, use, maintenance, sharing, or disclosure of data and information by such third parties. If you provide information directly to such sites, the privacy policy and terms of service on those sites are applicable and Company’s Group is not responsible for the information processing practices or privacy policies of such sites.

Your Personal Data may also be shared in connection with a corporate transaction, such as a sale of a subsidiary or a division, merger, consolidation, or asset sale, or in the unlikely event of winding-up.

We need to share Personal Data with various parties for the Purposes. These parties include:

Other users

For example:

• If you are a passenger, we may share your pick-up and drop-off locations with our driver partner fulfilling your service request.
• If you are a driver partner, we may share your Personal Data with your passenger including your name and photo; your vehicle makes, model, number plate, location and average rating.
• If you are a delivery partner, we may share your Personal Data with your selected merchant and user, including your name and photo; your vehicle makes, model, location and average rating.
• If you are using our Moevd Parcel service, we may share your Personal Data with the recipient of your parcel, and vice versa, as well as the delivery partner in charge of fulfilling your service request.
• If you are using Moevd Umrah service, we may share your personal data with the Umrah Agency for booking of umrah packages, visa application, accommodation and flight purposes. 
• If you are using Moevd Insure service, we may share your Personal Data with Insurance/ Takaful Agent for personal accident insurance, motor vehicle insurance and roadtax renewal.
• If you use our in-app chat service, we may share your mobile number and Moevd-registered name with the other parties to your chat.

With third parties

For example, we may share a vehicle’s location and driver’s and/or passenger’s name with third parties when a passenger uses the “Share Ride” feature or activates the Emergency Button.

Personal Information from Minors and Other Individuals

As a parent or legal guardian, please do not allow the minor (individuals under 18 (eighteen) years of age) under your care to submit Personal Data to Company’s Group. In the event that such Personal Data is provided to Company’s Group, you hereby consent to the processing of the minor’s Personal Data and personally accept and agree to be bound by this Notice and take responsibility for his or her actions.

In some circumstances, you may have provided personal data relating to other individuals (such as spouse, family members or friends) and in such circumstances you represent and warrant that you are authorized to provide their personal data to Company’s Group and you have obtained their consent for their personal data to be processed and used in the manner as set forth in this Notice.

Acknowledgement

By communicating with Company’s Group, using Company’s Group’s services, purchasing products from Company’s Group or by virtue of your engagement with Company’s Group, you acknowledge that you have read and understood this Notice and agree and consent to the use, processing and transfer of your Personal Data by Company’s Group as described in this Notice.

Company’s Group shall have the right to modify, update or amend the terms of this Notice at any time by placing the updated Notice on the Websites. By continuing to communicate with Company’s Group, by continuing to use Company’s Group’s services, purchasing products from Company’s Group or by your continued engagement with Company’s Group following the modifications, updates or amendments to this Notice, such actions shall signify your acceptance of such modifications, updates or amendments.

In the event of any conflict between the English and other language versions, the English version shall prevail.

Cancellation and Refund by Moevd Umrah Customer

For Free Independent Traveler (FIT) Travel Package (Individual)

• Booking cancellations must be made in writing to avoid misunderstandings. If the company receives notice to cancel the booking 30 days or more before the departure date, a minimum administration fee of RM50.00 or 10% of the travel deposit (whichever is lower) per person will be charged.

• If the cancellation notice is received 29 days or less before the departure date, the following charges will apply:

  3-7 working days before departure date	40% of the tour fare

• Each airline’s cancellation policy on special fare promotions shall apply in addition to the cancellation charges as set out in above clause (Note: Flight tickets are restricted and subject to the Airline Conditions. They may not be endorsed, may not be reissued, non-refundable and non-transferable. Any amendment to the route or change of travel date by any passenger is solely at his or her own risk. The company or its associated agents shall not be liable for any inconvenience and expenses incurred. However, any refund made by any airline for cancellations made 2 working days or less before the day of travel for non-promotional fares shall be paid to the tour member after deducting any administrative charges incurred by the tour company).

For Group Travel Packages

• Cancellations must be in writing to avoid misunderstandings. If the company receives notice to cancel the booking 45 days or more before the departure date, a minimum administration fee of RM30.00 or 2% of the travel fare (whichever is higher) per person will be charged.

• If notice of cancellation is received 44 days or less before the departure date, the following charges will apply:

• The cancellation policy of each airline for special fare promotions shall apply in addition to the cancellation charges as specified in clause 2.2. (Note: Flight tickets are restricted and subject to Airline Conditions. They may not be endorsed, non -reissue, non -refundable and non -transferable. Any changes to routes or change of travel dates are at his / her own risk. The company or its associated agents are not responsible for any complications arising and additional expenses incurred)

Cancellation and Refund by Moevd Umrah Agency

For FIT Travel Package (Individual)

• The Company reserves the right to cancel the tour in the event of a natural disaster, war, strike, riot or on the instructions of the Government of Malaysia beyond the company’s control.
• The company should recommend alternative tourism, preferably to the same destination or another tourism. If the passenger decides not to accept alternative travel, all money paid will be refunded to the passenger after deducting the administration fee to be paid.

For Group Travel Packages

• The Company reserves the right to cancel the tour in the event of a natural disaster, war, strike, riot or directive of the Government of Malaysia beyond the company’s control.
• The company should recommend alternative tourism, preferably to the same destination or another tourism. If the passenger decides not to accept alternative travel, all money paid will be refunded to the passenger after deducting the administration fee to be paid.
• If the company cancels the visit due to lack of passengers or inability to obtain transportation or accommodation, the company will refund all the money paid and also pay compensation as follows:
